Typically, the police report would find fault...
It's the police's job to take the information (and find out who is lying) and come up with a conclusion on what exactly happened.
The insurance companies then bases the liability on the police report.

If the insurance took your side, then it is their job to go track down the other yahoo and get them to pay.
This is also your insurance company's responsibility.
This is why you pay your insurance premiums every month.
